Default Four Pub Landlords in Court for card offences.

Good Afternoon everyone.

The latest on the thread of mine dated 15th March,Card dealer in court.

This is the word for word article in todays(19th March) North Wales regional newspaper, The Daily Post(Welsh Edition).

Four on tv charges.

Four publicans yesterday each denied having unauthorised Greek or Albanian satellite decoder cards for commercial purposes at bars in Conwy County, North Wales.
The four appeared seperately at Llandudno Magistrates Court and elected to stand trial before the Crown Court.
David Fare is alledged to have committed the offence at Ye Old Mail Coach at Conwy Town, The prosecution,brought by Conwy County Borough Council,claims he had a Greek decoder card and dishonestly recieved a TV programme. John Devonald is alledged
to have possessed an Albanian card at Llandudnos Fountain Cafe Bar,and David Owen at the Links Hotel Llandudno and Terrance Dickson at the Fairview Inn,Llandulas near Colwyn Bay,face similar
charges.
The cases were adjurned until May 20th.

Sorry guys I wiped the artcicle off the front page.
So to get it back, I added the following.
Conwy County is a seaside resort area,which borders Rhyl in Denbighshire,
It would appear some one as complained to Conwy County, as they will never raid without a spy. The areas population rises from Easter by a big%
thousands into a million plus etc.

Hi Bob, Very confusing this taking people to court for using card from overseas. I thought that it was the Perm League who were taking people to court for showing matches, now it appears that it is the local council who are taking this action.

To me it is all the same, it is just Sly who have everyone in their pockets and can get anything done, but not in their name of course.

Good Morning Kerrywez.

In the Uk, the enforcing agency can be one of two, County Council or some outfit connected to Customs and Revenue(I Think), who ever it was
as complained to the County Council, Sky comes to mind on this one.
However all four have elected trial,so they must have beern given some legal advice, E U Law it would seem may be on their side, strange though
the other counties are not involved that neighbour Conwy,Denbighshire
and Gwynedd,

Sky is very worried/ the question is has any law been broken. Why should the customs be involved anyway. These cards are not stolen or illegal (now thats a point are they illegal or not). many people in fact thousands in the london area have contracts with foreign satellites company and use there cards. Now we come to EEC and EU directives. In european law no law has been broken as the EU rules are not broken. If it is true that sky has complained to the local authoriteis then they must be getting very worried.
The way i look at it is think i will keep that to myself ! i may get banned

No-one on this forum gets banned for simply expressing their views as long as the forum rules are not broken. Techwatch is totally independent remember.

I might add a couple of points.

Only those alledged,(4 Pub Landlords) to be showing TV via Albania or Greece with decoder cards are being prosecuted because the tv was
in a commercial property open to the public.

Anyone at home with a similar card,watching for his/her own pleasure and not for gain can not be prosecuted. Sky tried this on a few years ago and dropped the case,when Sky was advised the case would be thrown out of court, as no law had been broken,in fact EU law supported the so called offender,This was a test case in Blackpool and reported in the local paper.

It will be interesting to see what happens, and yes Sky are worried, they have sucked the bowl dry.

Merlodlliw ! knows the law and its very interesting what he has said. My worry is that they will lose and get fined. Then i think they will take this ruleing to EU court. As a test case ! I am not a fan of the EU . The question is the commercial law is different ? from the private indivdual law. Law is law as far as i know. the only thing in commercial law proof does not have to be within reasonable doubt. This is wrong in my view.

In these cases, Greece is in the EU and Albania is not. So the Digitalb subscriber has a much weaker case if he's relying on EU law.

I almost said Albania was an EU member,we have Albanians in Wrexham running the Tesco Car hand car wash,much to the anoyance of the Poles, they of course(Albanians) do have easy visas, so come here and then like a 20 year old Irish Malt Whiskey, (preferably Paddy) disappear,so to speak. You are right Alb cards are the weaker case,and
Sky et al pay tv, will be looking for easy knock outs.
