Oh man!!! A$$holes

I spoke to customer relations to upgrade my TV a while ago and did, but now I don't think it's worth the upgrade I wanted to go back to the deal I was on before which I can get elsewhere anyway + cashback!!!

I have been told that I am in a contract??? WTF?

I do NOT recall being told this over the phone infact I am pretty adamant I wasn't told, but the guy I spoke to says his colleague Ryan is pretty reliable and his notes state that he informed me of the contract!

He said that they wrote out to me advising of the new changes and the contract. Yes I recall them writing to me but never read the letter as I was already aware of the changes and they send me that much junkmail I just binned it!

He also admitted that he probably wouldn't be able to get the call as it was so far back but the notes state that I was informed of the contract and it is legally binding!!!

What a load of tosh! I can't beleive it the sneaky buggers!

I feel like leaving them now just out of spite, and getting a full subject access report. I bet they can't provide a transcript of that call anyway

VM do keep all of the recordings of all of the calls. It takes them a long time to send a copy of those recordings out once they are archived. they archive locally once a week and then once a month these are moved to secure servers around the country. there is legislation that says these have to be kept fort he duration of the contract. Quite often you are better off not speaking with cust relations as the agents are told that they have to try ans save customers. they do these by offering alternative packages at lower prices to keep people on board. these packages normlly last 3 or 6 months before returning to original figure however every time they change certain aspects of the package that initiates a new 12 month contract. The cust relations team always read a set statement on package changes that says about the 12 month contract.

VM rang me today after I complained and asked for a transcript of the call.

The girl I spoke to admitted that they do not have a recording of the call, but their notes state that the rep advised me of the contract so that is good enough.

They also advised they wrote out to me to advise me of the contract, but I admitted that I threw the letter away without reading it as they send me that much mass marketing crap and as I didn't know anything about the contract I had no need to read about the changes I already knew where in place.

So where do I stand... If I am adamant I wasn't advised about the contract on the phone, but the notes say I was, yet they have no recording of the call to back it up then can I take this further?

Who do I compain to Ofcom? Trading standards? Am I fighting a losing battle?

I dont think its a losing battle as the notes cant really prove that much in my opinion. My point is that the advisor you spoke to could be telling you one thing and writing down something else on his notes.

You would need to complain to Ofcom regarding the matter but I would assume this is all down to how much evidence they have and what evidence you have.

Sounds to me like its your word against there's

But I could be wrong.

Id complain to Trading Standards as well, if their advisors are not telling people that they are entering in to another contract. If most of their advisors are doing this, then that hints to me that VM don't actually want to tell their customers, and simply tell their advisors to write it down in their "notes" for future reference

Yes I will do that, good idea.

It is VERY sneaky and I am considering leaving them all together, but I do love their steady broadband, shame that they give such crap service
